Terms and Conditions

These terms govern paid access to the South West Media fight-video service. Please read them before creating an account or starting a subscription. They do not remove any rights that consumers have under law.

1. Who we are

The service is operated by Ben Fitch, a sole trader trading as South West Media. Contact: admin@southwestmedia.co.uk.

2. The service

A membership gives the account holder a limited right to stream the fight footage made available during their access period. Availability can change for operational, licensing, legal or technical reasons. We will provide the service with reasonable care and skill and do not exclude obligations or remedies that cannot lawfully be excluded.

3. Accounts

You must be at least 18 to purchase a membership. Keep your login confidential and tell us promptly if you believe it has been compromised. A membership is for one account holder and personal, private viewing; it may not be sold, transferred or shared.

4. Price, renewal and older plans

The current offer for new subscribers is a monthly membership. The price shown at checkout—currently £3.50 per month—is the price that applies, and PayPal processes the recurring payment. The membership renews at the stated interval until cancelled.

Existing subscribers may keep an older monthly, annual, weekly or daily plan while that agreement remains valid. Changing the advertised price for future customers does not by itself alter an existing PayPal agreement. If a change is proposed to an existing agreement, we will give the notice and obtain any agreement required by law.

5. Starting access and cancellation rights

You can cancel future renewal from your account or through PayPal. Cancellation normally stops future charges; access may continue to the recorded paid-through date unless the agreement says otherwise.

If you have a statutory cooling-off right, you may exercise it by sending a clear cancellation statement to admin@southwestmedia.co.uk. Where you expressly ask for digital access to begin immediately and start streaming, your cancellation right may be affected or lost to the extent permitted by law. Nothing in these terms limits a refund, cancellation or other remedy that the law requires.

6. Personal-viewing licence and copyright

All footage, edits, graphics and branding supplied through the service are owned by South West Media or used with permission. Membership grants only a personal, non-exclusive, non-transferable and revocable licence to stream footage through the authorised player.

You must not download, copy, screen-record, capture, reproduce, clip, edit, sell, share, rebroadcast, publicly show, upload or otherwise distribute the footage. You must not share credentials, bypass the paywall or player controls, extract source links, remove an account mark, or help another person do any of these things.

7. Suspected theft or misuse

To protect fighters, promoters and our work, the player may display the signed-in username and South West Media mark. We may also retain privacy-minimised playback and security records as described in our Privacy and Cookie Policy.

Where we have reasonable evidence of serious copying, account sharing or redistribution, we may suspend access immediately while we investigate and may terminate the account. We will not normally give a discretionary refund for a period lost because of a serious breach, but this does not affect any refund or other right required by law.

We may preserve evidence, issue copyright takedown requests or strikes to social-media and hosting platforms, notify relevant rights holders, and pursue other proportionate civil or criminal remedies where appropriate. We will handle personal information lawfully when doing so.

8. Fair use of the service

Do not probe, overload, scrape or interfere with the website, player, accounts or payment systems. Automated access is prohibited except where we have authorised it in writing. We may apply proportionate security controls to protect the service and its members.

9. Interruptions and changes

Internet and third-party hosting services can fail. We may maintain, repair or update the service and will try to minimise material interruption. We are responsible where the law says we are responsible; we do not exclude liability for death or personal injury caused by negligence, fraud, faulty or misdescribed digital content, failure to use reasonable care and skill, or any other liability that cannot legally be excluded.

10. Ending an account

You may end renewal as described above. We may end or suspend access for a serious or repeated breach, non-payment, a security threat, or where continuing the service would be unlawful. Where practical and appropriate we will explain the reason and provide a way to contact us.

11. Changes to these terms

We may update these terms for legal, security, payment or service changes. Material changes affecting existing members will be presented clearly and, where required, will need acceptance before protected playback continues.

12. Law and complaints

These terms are governed by the law of England and Wales. If you live elsewhere in the UK, you keep any mandatory protections and right to bring proceedings available where you live. Please contact admin@southwestmedia.co.uk first so we can try to resolve a complaint.
